What am I entitled to after being involved in a motorcycle accident? You may be entitled to money for your pain and suffering. You may be entitled to money for your medical expenses. You may be entitled to money for your lost wages. You may be entitled to have someone care for you and be paid for it. You may be entitled to money to get your bike fixed and get you back on the road.
How much does it cost to hire an attorney? Our attorneys work on a one-third contingency fee basis. If we collect nothing, we take nothing. You put no money up front and we pay all the up front costs. These costs will be reimbursed to us upon successful resolution of your case.
What type of motorcycle coverage should I have and how much? If you are involved in a motorcycle accident, it would certainly be best if the person who caused the motorcycle accident had a lot of insurance. That is rarely the case. Statistics have shown that approximately 25% of Michigan drivers are uninsured. When it comes down to some people feeding their children or paying the premium on their car insurance, guess which one wins? That is why you should have uninsured motorist coverage. Please don't think that just because your insurance agent tells you have "full coverage" that you have uninsured motorist coverage. That is many times not the case. You must check your policy. The coverage should be at least $100,000/$300,000 for uninsured coverage so that you're covered if somebody hits you and they are uninsured. Your chances are 1 out of 4 that an uninsured driver will be at fault in your motorcycle accident. The cost of this insurance is very reasonable. It should cost you approximately the price of a carton of cigarettes. Underinsured coverage Underinsured motorist coverage picks up where the other driver's insurance runs out. Many drivers in Michigan only have $20,000 liability insurance. If you have $100,000 in underinsured coverage, your company would then be responsible for up to an additional $80,000.00. Unfortunately, there are only 2 companies at this time that offer this insurance. They are Foremost Insurance and GMAC. If you buy $100,000 worth of uninsured coverage with these companies, the underinsured coverage should come with it for FREE. You owe it to yourself and your family to have this coverage. Collision coverage Collision coverage pays for the damage to your motorcycle less your deductible. This coverage applies without regard to fault. If you do not have collision coverage on your motorcycle, you will be responsible for fixing your own bike even if the other person causes the motorcycle accident. You must have collision coverage.
What if I am the cause of the motorcycle accident? It is interesting that in Michigan you may still collect monies if you are the sole cause of the motorcycle accident. In Michigan, the Statute states: "A person suffering accidental bodily injury arising from a motor vehicle accident which shows evidence of the ‘involvement' of a motor vehicle while an operator or a passenger of a motorcycle shall claim personal protection insurance benefits from insurers in the following order of priority: (a) the insurer of the owner of the registrant of the motor vehicle involved in the motorcycle accident; (b) the insurer of the operator of the motor vehicle involved in the motorcycle accident, (c) the motor vehicle insurer of the operator of the motorcycle involved in the motorcycle accident, (d) the motor vehicle insurer of the owner or registrant of the motorcycle involved in the accident."
What does all this mean to you as a motorcycle rider? It means that even if your are the sole cause of a motorcycle accident, you may collect personal injury protection "PIP" benefits Over the last 20 years that we have represented motorcycle riders, we have collected hundreds of thousands of dollars for bikers who were at fault in their own motorcycle accident. That is why you need a specialist in motorcycle law. That is why you need a lawyer who rides.
What do I do if I'm in a motorcycle accident? Obviously, you should give your statement to the police investigating the motorcycle accident. After that, it is best not to make any statements to any other persons or insurance companies before contacting the Michigan Bikers Association. The insurance company's adjuster will most likely contact you in order to get a recorded statement. They will pull out all the tricks to get you to say what they need in order to deny you coverage. Do not talk to them. We hear this all the time... "your client, the motorcycle rider was driving too fast or weaving in and out of traffic." The best one is when they tell us that they did not see you because you did not have on your headlight. As a motorcycle rider you are always the target. It is our job to paint that target, where it belongs, on the party that caused your motorcycle accident. Our team at Michigan Bikers Association is one that is very relaxed with a friendly and comfortable environment. We understand motorcycle riders. We want you to be at ease when you come visit us. Most people believe that lawyers have an attitude about them. We don't. You will find us easy to talk to no matter what your questions. You can reach us at any time of the day. Call 1-800-MI-BIKER and you will either reach us immediately or the answering service will find us immediately. And we will call you back. You don't talk to paralegals or secretaries; you talk to your lawyer. |
